These Terms constitute a legally binding agreement between you and Maple54, operating as MapleVoice. By accessing or using our Services, deploying an AI voice agent, or opting in to any of our communication programs, you agree to be bound by these Terms.

MapleVoice Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you ("you," "Customer," or "user") and Maple54, LLC, operating under the brand name MapleVoice ("MapleVoice," "Company," "we," "us," or "our"). They govern your access to and use of our website, AI voice agent platform, related applications and APIs, and any text-message (SMS) program you enroll in (collectively, the "Services").

By accessing the website, creating an account, deploying an AI voice agent, opting into our SMS program, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

These Terms are designed to comply with the Telephone Consumer Protection Act (TCPA) as amended through 2026, the FCC's one-to-one consent rule, The Campaign Registry (TCR) 10DLC requirements, CTIA Messaging Principles and Best Practices, and the CAN-SPAM Act.

1. Definitions

  • "Services" — the MapleVoice website, AI voice agent platform, applications, APIs, and SMS program.
  • "Customer" — the business or individual that registers for, subscribes to, or uses the Services.
  • "End User" — a caller, message recipient, or other individual who interacts with a Customer's AI voice agent or messaging.
  • "Customer Data" — call recordings, transcripts, contact lists, scripts, and other data submitted to or generated through the Services on a Customer's behalf.
  • "SMS Program" — the recurring text-messaging service operated through the Services.

2. The Services

MapleVoice provides fully managed AI voice agent services that answer inbound calls, place outbound calls where authorized, qualify leads, book appointments, take orders, and send related text-message notifications on behalf of our Customers. We configure and operate the agent for you, with a guided onboarding that aims to take your agent live in approximately 48 hours.

We may modify, enhance, or discontinue features of the Services from time to time. We will use commercially reasonable efforts to provide reliable service but do not guarantee that the Services will be uninterrupted or error-free.

3. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly at info@maplevoice.ai of any unauthorized use.

4. Subscriptions, Fees & Billing

  • Fees — subscription fees are described at the point of purchase and are billed in advance on a recurring basis. Card payments are processed by our PCI-compliant payment processor, Stripe.
  • Renewals — subscriptions automatically renew for successive periods unless cancelled before the end of the then-current term.
  • Taxes — fees are exclusive of applicable taxes, which are your responsibility.
  • Cancellation — you may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
  • Changes to pricing — we may change pricing on renewal with prior notice.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with these Terms. You agree not to:

  • Use the Services in violation of any applicable law or regulation, including telemarketing, consumer-protection, fair-lending, or privacy laws.
  • Use the Services to send unlawful, harassing, deceptive, fraudulent, or unsolicited messages, or any content prohibited by carriers or CTIA guidelines (including the regulated "SHAFT" categories: sex, hate, alcohol, firearms, and tobacco, where restricted).
  • Place or send communications to any person who has not provided the required consent, or who has opted out or is otherwise on a Do Not Call or internal suppression list.
  • Attempt to gain unauthorized access to the Services, other accounts, or connected systems, or interfere with their security or integrity.
  • Reverse engineer, resell, or misuse the Services, or use them to build a competing product.
  • Transmit viruses, malware, or any code intended to disrupt or impair the Services.

6. Customer Compliance Responsibilities

Where you use the Services to contact your own End Users, you are the sender of those communications and are solely responsible for compliance, including:

  • Obtaining and documenting the required prior express (and, where applicable, prior express written) consent from each End User before calls or texts are placed.
  • Honoring opt-out requests promptly and maintaining internal Do Not Call and suppression lists.
  • Respecting permitted calling hours and all federal and state telemarketing restrictions.
  • Complying with call-recording laws, including one- and two-party (all-party) consent states, and providing any required recording or AI-interaction disclosures to End Users.
  • Providing accurate, lawful scripts, knowledge bases, and campaign content.
  • Completing any required brand and campaign registration with The Campaign Registry for 10DLC messaging.

You will indemnify MapleVoice for claims arising from your communications or your failure to meet these responsibilities, as described in the Indemnification section.

7. SMS Program Terms

Our SMS Program operates under the 2026 TCPA, the FCC's one-to-one consent rule, The Campaign Registry (TCR) 10DLC requirements, and CTIA Messaging Principles and Best Practices.

7.1 Program description

By opting in, you agree to receive recurring text messages such as notifications, appointment confirmations and reminders, booking and order updates, callback and follow-up notifications, account and service alerts, and customer-care responses on the number you provide.

7.2 One-to-one consent

Participation requires explicit one-to-one consent. By opting in, you consent to receive messages from the single business you provided consent to. Your consent is never shared with other companies, affiliates, or third parties without your direct approval.

7.3 Consent is not a condition of purchase

Your consent to receive text messages is voluntary and is not a condition of purchasing any goods or services.

7.4 How you opt in

  • Web form — by checking a clearly labeled, unchecked-by-default checkbox that states you agree to receive text messages, presented with links to these Terms and our Privacy Policy.
  • Keyword — by texting a published opt-in keyword to our number.
  • Verbal or written — by providing express consent verbally (recorded) or on a signed form.

7.5 Message frequency

Message frequency varies but typically does not exceed 3–5 messages per week outside of event-driven notifications such as an appointment reminder or order confirmation.

7.6 Message and data rates

Message and data rates may apply. Message frequency may vary. Standard carrier rates apply per your mobile plan, and MapleVoice is not liable for carrier charges.

7.7 Opt-out (STOP) and help (HELP)

  • Reply STOP at any time to unsubscribe; you will receive one confirmation message and no further texts unless you opt back in.

7.8 Privacy

Your mobile number and message-interaction data are handled in accordance with our Privacy Policy: https://www.maplevoice.ai/privacy-policy. No mobile information or SMS opt-in data is shared with third parties or affiliates for marketing or promotional purposes.

7.9 Supported carriers & delivery

Message delivery depends on carrier networks and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

8. Intellectual Property

The Services and all related software, models, text, graphics, logos, and the "MapleVoice" name and marks are owned by Maple54, LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes during your subscription. You retain ownership of your Customer Data. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted.

Any feedback or suggestions you provide may be used by MapleVoice without restriction or obligation to you.

9. Customer Data, Privacy & Security

Our collection and use of personal information is described in our Privacy Policy. For workflows involving Protected Health Information (PHI), a Business Associate Agreement (BAA) is required as described in our HIPAA Compliance Statement at https://www.maplevoice.ai/hipaa-compliance. We maintain administrative, technical, and physical safeguards — including TLS 1.3 in transit and AES-256 at rest — designed to protect Customer Data, and we do not use Customer Data to train general-purpose or shared AI models.

10. Third-Party Services & Integrations

The Services may interoperate with third-party products (such as CRMs, calendars, payment processors, and telephony or AI providers). Your use of those products is governed by their own terms and privacy policies. We are not responsible for third-party products, and your use of an integration may require you to grant that third party access to your data.

11. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. MapleVoice does not warrant that the Services will be uninterrupted, secure, or error-free, or that messages or calls will be delivered without delay. MapleVoice provides a technology platform and does not provide legal, compliance, medical, or financial advice; you are responsible for determining whether your use of the Services complies with the laws that apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, MapleVoice and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Services, even if advised of the possibility of such damages.

MapleVoice's total aggregate liability for all claims arising out of or relating to these Terms or the Services will not exceed the amounts you paid to MapleVoice for the Services in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless MapleVoice and its affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms or applicable law; (iii) the communications you send through the Services or your failure to obtain required consent; or (iv) your violation of any third-party right.

14. Term & Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access, with or without notice, if you breach these Terms, create a security or compliance risk, or fail to pay fees when due. You may stop using the Services at any time. Upon termination, your right to use the Services ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, for any dispute not subject to arbitration.

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration rather than in court, and you and MapleVoice waive any right to a jury trial or to participate in a class action. Either party may bring claims in small-claims court where eligible. Nothing in this section limits a consumer right that cannot be waived by contract.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last Updated" date and, where appropriate, communicated by email or SMS. Your continued use of the Services after an update constitutes acceptance of the revised Terms. Changes do not retroactively alter agreements already executed.

17. Miscellaneous

  • Entire agreement — these Terms and the Privacy Policy are the entire agreement between you and MapleVoice regarding the Services and supersede prior agreements on that subject.
  • Severability — if any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver — our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure — neither party is liable for delays or failures caused by events beyond its reasonable control.
